myShape Style Spa Shopping Spree Contest
Official Rules
myShape’s Style Spa Shopping Spree Contest is intended for participation only in the 50 United States and the District of Columbia (“U.S.”) and shall be construed according to, and governed exclusively by, U.S. law. Do not participate in the Contest unless you meet the eligibility requirements set forth below and are a legal resident physically located in the United States at the time of entry.

Promotion Description
myShape’s Style Spa Shopping Spree Contest begins on or about
midnight, 12:00 AM Pacific Time (PT), on December 1, 2008, and ends
on or about 11:59 PM PT on December 14, 2008. At the end of the Promotion
Period, a random drawing will be conducted to select one (1) winner from
all eligible entries submitted during the Promotion Period. Entry in the
Promotion does not constitute entry into any other promotion, contest or
sweepstakes.
Eligibility
THE PROMOTION IS OPEN ONLY TO ENTRANTS WHO ARE (i) LEGAL RESIDENTS OF THE
U.S. OR THE DISTRICT OF COLUMBIA LOCATED IN THE U.S. AND (ii) 18 YEARS OF
AGE OR OLDER AT THE TIME OF ENTRY. Directors, officers and employees of
myShape, Inc (“Sponsor”) and any of its respective affiliate
companies, subsidiaries, agents, professional advisors, advertising and
promotional agencies (collectively, “Released Parties”), and
immediate family members (mother, father, brothers, sisters, sons, daughters
and spouse) and/or those living in the same household of any such employees,
whether or not related, are not eligible to enter or win. Promotion is void
where prohibited by law.
How to Participate
To enter, visit www.myshape.com (the “Website”) and create a
free myShape Personal Shop to receive one (1) promotion entry. Limit one (1)
entry per person and/or per email address during the Promotion Period. All
entries must be received by the end of the Promotion Period in order to be
considered eligible. The Website’s database clock will be the official
timekeeper for the Contest. Entrants must provide a valid email address to be
eligible, and all other required information must be completed to enter and to
be eligible to win. Incomplete entries will be disqualified. Proof of entering
information at the Website is not considered proof of delivery to or receipt by
Sponsor of such entry.
Important Notice for Online Entry Method
Internet entry must be made by the entrant, only at the Website. Entries made
by any other individual or any entity and/or originating at any other website
or email address, including but not limited to commercial contest subscription
notification and/or entering service sites, will be declared invalid and
disqualified from this Contest. The use of any device to automate the entry
process is prohibited.
The name of the “authorized account holder” associated with any given email address will be deemed to be the entrant who must comply with and abide by these Official Rules. The authorized account holder is defined as the natural person who is assigned an email address by an Internet access provider, an online service provider or another organization that is responsible for assigning email addresses or the domain associated with the submitted email address. Proof (to Sponsor’s satisfaction) of being the authorized account holder may be required by Sponsor, in Sponsor’s sole discretion. If a dispute as to the identity of the authorized account holder or any potential winner cannot be resolved to Sponsor’s satisfaction, the entry will be deemed ineligible. The Released Parties shall not be responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error that may occur in the processing of the entries in the Contest. The Released Parties assume no responsibility or liability for any error, omission, interruption, deletion, theft or destruction, unauthorized access to or alteration of entries. Sponsor is not responsible for lost, incomplete, late, damaged or misdirected entries, text or email messages, failures or malfunctions of phones (including wireless phones/handsets; phone lines or telephone systems or other communications malfunctions; cellular equipment towers, telephone systems or wireless services, interrupted or unavailable network, server or other connections including those through and/or by www.myshape.com; miscommunications, failed computer hardware or software or other technical failures; garbled, lost, misrouted or scrambled transmissions; any error, omission, interruption, defect or delay in any transmission or communication; traffic congestion on the Internet or for any technical problem, including but not limited to any injury or damage to an entrant’s or any other person’s computer related to or resulting from participation in this Contest or by visiting the Website; printing or other errors appearing within these Official Rules or in any Contest-related advertisements or other materials; or other errors or problems of any kind whether mechanical, human, technical, electronic, cellular telephone-related or otherwise. By entering this Contest, entrants give their express permission to be contacted by Sponsor by telephone, email and/or postal mail for Contest purposes only.
Winner Selection/Odds
At the end of the Promotion Period, Sponsor will select one (1) winner in a random
drawing from all eligible entries received during the Promotion Period. Sponsor’s
decisions will be final and binding in all matters relating to this Contest. The
potential winners will be notified by telephone, email and/or postal mail using
the contact information provided at the time of entry. Sponsor shall have no liability
for any winner notification that is lost, intercepted or not received by the potential
winner for any reason. If, despite reasonable efforts, a potential winner does not
respond within seven (7) days of the first notification attempt, or if the prize or
prize notification is returned as unclaimed or undeliverable to such potential winner,
such potential winner will forfeit his or her prize and an alternate winner may be
selected. If any potential winner is found to be ineligible, or if he or she has not
complied with these Official Rules or declines a prize for any reason prior to award,
such potential winner will be disqualified and an alternate winner may be selected.
Odds of winning will depend on the number of eligible entries received.
Prizes
One (1) prize is available for the Shopping Spree Contest. The prize winner may
select and receive one thousand dollars ($1,000) worth of merchandise from the
myShape.com website. Prize winners will be responsible for all federal, state
and local taxes related to the prize and/or this Contest. Each prize winner will
receive a one-hour style makeover session with Patty Fox, Fashion Coordinator
for the Academy Awards®.
Use of Winner’s Name, Likeness, Etc.
Except where prohibited by law, entry into the Promotion constitutes permission
to use a winner’s name, city and state of residence, likeness (i.e., photo
or otherwise), prize information and/or a quote for promotional purposes without
further permission or compensation.
Miscellaneous
No transfer, assignment or substitution of any prize (or portion thereof) is
permitted, except by Sponsor due to prize unavailability, and then for a prize
(or applicable portion thereof) of equal or greater value. Each prize winner will
be required to execute and return an Affidavit of Eligibility, Liability Release
and (where legal) Publicity Release (collectively, the “Affidavit/Release”)
within five (5) days of issuance of notification. Designation of each winner is
subject to receipt and verification of the Affidavit/Release. By participating,
entrants agree to be bound by these Official Rules and agree that: (1) Released
Parties and their designees may use (unless such condition is prohibited by law)
their name, voice, city/state of residence, photograph and/or likeness for
advertising and/or trade and/or for the purpose of winner announcements on
Sponsor’s website (and the advertising and/or promotion thereof) and/or
for any other purpose in any media or format now or hereafter known without
further compensation, permission or notification and (2) Released Parties and
their designees and assigns shall have no liability and will be held harmless
for any liability, loss, injury or damage, including, without limitation,
personal injury, death or damage to personal or real property, to entrant or
any other person or entity due in whole or in part, directly or indirectly,
by reason of the acceptance, possession, use or misuse of any prize (including
any travel or other activity related thereto) or participation in this Contest
or any Contest-related activity. Sponsor reserves the right, in its sole discretion,
to modify, terminate or suspend this Contest should viruses, bugs, non-authorized
human intervention or other causes beyond the reasonable control of Sponsor
corrupt or impair the administration, security, fairness or proper play of the
Contest and, in the event of termination or suspension at its discretion, select
the winners from those eligible, non-suspect entries received prior to the event
requiring such termination or suspension. Inclusion in such drawing shall be each
entrant’s sole and exclusive remedy under such circumstances. Only the type
and quantity of prizes described in these Official Rules will be awarded. Sponsor
reserves the right to terminate the affected Contest or online entry if technical
difficulties compromise the integrity or ability to continue online entry. ANY
ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE THE WEBSITE
OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST, OR TO ANNOY, ABUSE, THREATEN
OR HARASS ANY OTHER PERSON IN CONNECTION WITH THE CONTEST, IS IN VIOLATION OF
CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES
THE RIGHT TO DISQUALIFY THE APPLICABLE INDIVIDUAL AND SEEK DAMAGES AND OTHER
REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. If any
provisions of these Official Rules are determined to be invalid or unenforceable,
these Rules shall otherwise remain in effect and shall be construed in accordance
with their terms as if the invalid or unenforceable provision were not contained herein.

For the winning names (available after December 14, 2008), send a self-addressed,
stamped envelope for receipt after December 14, 2008, and before February 28, 2009,

Privacy
Entry information may be shared with third parties to the extent required for winner
selection and prize fulfillment purposes. Except as provided in these Official Rules,
entry information submitted in this Contest shall be used in accordance with
Sponsor’s Privacy Policy, located at http://www.myshape.com/shop/privacy.
